Website Terms of Use

These Website Terms of Use (“Terms”) govern your access to and use of www.beyondbrush.co (the “Website”), operated by 2414186 Alberta Inc., doing business as Beyond Brush (“Beyond Brush,” “we,” “us,” or “our”).

By using the Website, you agree to these Terms. If you do not agree, do not use the Website.

Beyond Brush provides digital marketing services. The Website provides general information about our business and allows visitors to contact us about potential services.

Information on the Website is provided for general informational purposes only. It is not an offer, quote, professional recommendation, or guarantee that any service is available or appropriate for you.

Submitting a contact form or communicating with us does not create a client, agency, partnership, fiduciary, or other professional relationship and does not require either party to proceed with an engagement.

The scope, deliverables, pricing, payment schedule, timing, cancellation rights, ownership rights, and other terms for digital marketing services will be set out in a separate proposal, statement of work, contract, or other written agreement accepted by both parties (a “Service Agreement”).

If these Terms conflict with a Service Agreement, the Service Agreement governs with respect to the services covered by it.

Any prices, examples, or descriptions shown on the Website are informational and may change without notice. Final pricing and payment terms depend on the services and scope agreed upon by the parties in a Service Agreement.

We do not accept payments directly through the Website. If we offer payment through a third-party provider such as Stripe or PayPal in connection with a Service Agreement or invoice, that provider’s terms and privacy policy also apply. Beyond Brush does not receive or store complete payment-card details through the Website.

Marketing performance depends on many factors outside our control, including market conditions, platform changes, audience behaviour, competition, budgets, client decisions, and third-party systems.

Unless expressly stated in a Service Agreement, we do not guarantee any particular ranking, traffic level, number of leads, conversion rate, revenue, return on investment, advertising result, or other business outcome.

Testimonials, examples, portfolio materials, and past results do not promise or guarantee future performance.

You agree not to:

  • use the Website for any unlawful, fraudulent, harmful, or abusive purpose;
  • interfere with the Website’s security, availability, or proper operation;
  • attempt to gain unauthorized access to the Website, its systems, or information;
  • introduce malware, automated scraping tools, or other harmful or disruptive technology;
  • impersonate another person or misrepresent your identity or authority;
  • submit information that is false, misleading, defamatory, infringing, or unlawful; or
  • copy, reproduce, distribute, modify, or exploit Website content except as permitted by these Terms or applicable law.

We may restrict or block access to the Website if we reasonably believe these Terms have been violated.

The Website and its content—including text, graphics, branding, logos, designs, layouts, photographs, videos, and software—are owned by or licensed to Beyond Brush and are protected by intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Website for your personal or internal business information. No other rights are granted.

“Beyond Brush” and associated branding may not be used without our prior written permission. Rights in client deliverables are governed by the applicable Service Agreement.

You represent that information you submit through the Website is accurate, that you have the right to provide it, and that doing so does not violate any law or third-party right.

You authorize us to use submitted information to respond to your inquiry, evaluate a potential engagement, operate our business, and communicate with you in accordance with our Privacy Policy.

Do not send confidential, proprietary, or sensitive information through the Website unless we specifically request it. Information submitted before a Service Agreement is formed will not be treated as client-confidential information unless we expressly agree otherwise in writing.

The Website may use or link to third-party websites, platforms, applications, or services. We do not control and are not responsible for their availability, accuracy, security, content, policies, or practices. Your use of third-party services is governed by their own terms.

We may change, suspend, or discontinue any part of the Website at any time. We do not guarantee that the Website will always be available, secure, complete, accurate, current, or free from errors or harmful components.

To the fullest extent permitted by law, the Website and its content are provided “as is” and “as available,” without representations, warranties, or conditions of any kind, whether express, implied, statutory, or collateral, including warranties or conditions of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

Nothing in these Terms excludes any representation, warranty, condition, or right that cannot lawfully be excluded.

To the fullest extent permitted by law, Beyond Brush and its directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive loss arising from or relating to the Website, including loss of profits, revenue, data, goodwill, business opportunity, or anticipated savings.

We will not be liable for loss arising from reliance on Website content, Website unavailability, third-party services, unauthorized access, malicious code, or information you send through the Website.

These limitations apply regardless of the legal theory asserted and even if we were advised of the possibility of the loss. They do not apply where liability cannot legally be limited or excluded. Liability arising from digital marketing services is governed by the applicable Service Agreement.

To the extent permitted by law, you agree to indemnify and hold harmless Beyond Brush and its directors, officers, employees, contractors, and agents from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Website, your violation of these Terms, or information you submit in violation of another person’s rights.

Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy and Cookie Policy.

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-law principles.

Subject to any rights you may have under mandatory consumer-protection law, the courts located in Calgary, Alberta will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Website, and you consent to that jurisdiction and venue.

If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a corporate reorganization, financing, merger, sale, or transfer of our business.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us concerning use of the Website. They do not replace a Service Agreement.

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Your continued use of the Website after an update constitutes acceptance of the revised Terms, subject to applicable law.
